1. Introduction
These Terms and Conditions (hereinafter referred to as the "Terms") govern the access to and use of the website www.AfficheServices.fr (hereinafter referred to as the "Site") and the services provided by the AfficheServices platform (hereinafter referred to as the "Platform"). The Platform is operated by AfficheServices (hereinafter referred to as the "Operator"), a company dedicated to providing an online directory that lists businesses operating or offering services in France.
By accessing or using the Site, you (hereinafter referred to as the "User") acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Legal Notices, Privacy Policy, and, where applicable, our General Terms of Sale (GTS) for any paid services. These documents form an integral part of the contractual relationship between you and the Operator.
Access to and use of the Site imply your full and unconditional acceptance of these Terms, regardless of whether you are a resident of France, the European Union, or any other jurisdiction.
The Operator reserves the right to modify these Terms at any time, for reasons including but not limited to legal, technical, or commercial developments. Such modifications will be effective upon their publication on the Site. Users are encouraged to review this page regularly to stay informed of any updates. The version of the Terms in force is the one published on the Site at the time of your access or use. Continued use of the Site after any changes constitutes your acceptance of the revised Terms.

2.5 "Content"
Any text, images, videos, audio, data, software, or other materials uploaded, posted, displayed, or otherwise made available on the Site or Platform by Users or the Operator.
2.6 "Services"
All functionalities offered by the Platform, including free directory listings, search tools, user-generated reviews, and premium services such as enhanced visibility or advertising, which may be subject to separate fees as outlined in the GTS.
2.7 "Intellectual Property Rights"
All patents, copyrights, trademarks, trade secrets, database rights, and other intellectual property rights recognised under applicable laws.
2.8 "Force Majeure Event"
Any event beyond the reasonable control of the Operator, including but not limited to acts of God, war, terrorism, pandemics, natural disasters, strikes, governmental restrictions, or failures in telecommunications or internet services.
These definitions are intended to provide clarity and shall apply throughout these Terms. Any undefined terms shall be interpreted in accordance with their ordinary meaning in the context of online directory services.
3. Eligibility and User Accounts
3.1 Eligibility Requirements
To access and use the Site and Platform, Users must be at least 18 years of age or the age of majority in their jurisdiction, whichever is higher. By using the Site, you represent and warrant that you meet this eligibility criterion. The Operator reserves the right to refuse access to any User who does not meet these requirements or who provides false information.
Users must also ensure that their use of the Site complies with all applicable laws in their jurisdiction. The Platform is primarily intended for Users in France and the European Union, but access is available globally, subject to local legal restrictions. If accessing from outside the EU, Users are solely responsible for ensuring compliance with their local laws, including data protection and consumer protection regulations.
3.2 Account Registration
Certain features of the Platform, such as posting reviews, listing a business, or accessing premium services, require the creation of a user account ("Account"). To register, Users must provide accurate, current, and complete information, including a valid email address and password. You agree to maintain and promptly update your Account information to keep it accurate and complete.
The Operator may, at its discretion, reject any registration request or require additional verification, such as proof of identity or business ownership, particularly for Business Users. Accounts are personal and non-transferable; sharing login credentials is strictly prohibited and may result in suspension or termination.
3.3 Account Security
Users are responsible for maintaining the confidentiality of their Account credentials and for all activities that occur under their Account. You must immediately notify the Operator of any unauthorised use or security breach. The Operator shall not be liable for any loss or damage arising from your failure to comply with this obligation.
In the event of suspected unauthorised access, the Operator may suspend or terminate the Account without prior notice to protect the integrity of the Platform.
3.4 Account Types
- Visitor Accounts: No registration required; limited to browsing and basic search functions.
- Registered User Accounts: For individuals wishing to post reviews or interact with content.
- Business User Accounts: For entities listing services, which may involve verification processes and adherence to additional terms in the GTS.
Each account type grants varying levels of access, and Users must not attempt to circumvent these restrictions.
4. Services Provided by the Platform
4.1 Description of Services
The Platform operates as an online directory facilitating the discovery and promotion of businesses in France. Key services include:
- Directory Listings: Free or paid listings of business profiles, including contact details, descriptions, and locations.
- Search and Discovery Tools: Advanced search functionalities allowing Users to find services based on categories, locations, ratings, and keywords.
- User Reviews and Ratings: A system for Registered Users to submit feedback on listed businesses, subject to moderation.
- Premium Services: Optional paid features, such as featured listings, advertising banners, or analytics tools, governed by the GTS.
The Operator strives to ensure the accuracy and relevance of listings but does not guarantee the quality, legality, or performance of any listed business or service.
4.2 Availability and Modifications
Services are provided on an "as is" and "as available" basis. The Operator may modify, suspend, or discontinue any part of the Services at any time, with or without notice, for reasons including maintenance, upgrades, or legal compliance. Users acknowledge that the Platform may experience downtime due to technical issues, and no compensation will be provided for such interruptions unless otherwise specified in the GTS for paid services.
4.3 Third-Party Services
The Platform may integrate or link to third-party services, such as payment processors, mapping tools, or external websites. The Operator is not responsible for the content, privacy practices, or performance of these third parties. Users engage with such services at their own risk and should review the relevant third-party terms.
4.4 Geographic Focus
While the Platform focuses on businesses in France, it may include international listings where relevant. Users outside France should be aware that services may not be optimised for their location, and currency conversions or international fees may apply to paid features.
5. User Obligations and Conduct
5.1 General Obligations
Users agree to use the Site and Platform solely for lawful purposes and in a manner that does not infringe the rights of others or restrict their enjoyment of the Services. You must comply with all applicable laws, including those related to data protection (e.g., GDPR), consumer rights, and anti-discrimination.
5.2 Prohibited Activities
Users shall not:
- Engage in any form of harassment, abuse, or discriminatory behaviour towards other Users or listed businesses.
- Upload, post, or transmit Content that is illegal, defamatory, obscene, invasive of privacy, or infringing on Intellectual Property Rights.
- Use automated systems (e.g., bots, scrapers) to access or extract data from the Site without prior written consent from the Operator.
- Attempt to interfere with the Platform's functionality, such as through hacking, denial-of-service attacks, or spreading malware.
- Misrepresent affiliations, impersonate others, or provide false information in listings or reviews.
- Use the Platform for commercial solicitation unrelated to the directory services, such as spamming or pyramid schemes.
Violation of these prohibitions may result in immediate Account suspension, Content removal, and potential legal action.
5.3 Content Submission Guidelines
When submitting Content (e.g., reviews, business descriptions), Users must ensure it is accurate, truthful, and not misleading. Reviews should be based on genuine experiences. The Operator reserves the right to moderate, edit, or remove any Content at its discretion, without liability.
Business Users listing services must provide verifiable information and update listings promptly if details change. False or outdated listings may be removed, and repeated offences could lead to permanent bans.
5.4 Responsibility for User-Generated Content
Users retain ownership of their Content but grant the Operator a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, distribute, and display such Content for the purposes of operating and promoting the Platform. You represent that you have all necessary rights to grant this licence and that the Content does not violate third-party rights.
The Operator does not endorse User-generated Content and disclaims liability for its accuracy or appropriateness. Users are solely responsible for any claims arising from their Content.
6. Intellectual Property
6.1 Ownership
The Site, Platform, and all associated Content (excluding User-generated Content) are owned by the Operator or its licensors and are protected by Intellectual Property Rights. This includes trademarks (e.g., "AfficheServices.fr"), logos, designs, text, graphics, and software.
6.2 Licence Grant
Subject to these Terms, the Operator grants Users a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and Services for personal or internal business purposes. This licence does not permit commercial exploitation, reproduction, or distribution of the Operator's Content without express written permission.
6.3 Restrictions
Users shall not copy, modify, reverse-engineer, or create derivative works from the Operator's Intellectual Property. Any unauthorised use may result in termination of access and legal remedies, including claims for damages.
6.4 Trademarks
The Operator's trademarks may not be used in connection with any product or service without prior consent. Users must not imply endorsement or affiliation with the Operator.
6.5 Reporting Infringements
If you believe your Intellectual Property Rights have been infringed on the Platform, please contact the Operator with details, including evidence of ownership and the location of the infringing material. The Operator will investigate and take appropriate action in accordance with applicable laws, such as the EU Digital Single Market Directive.
7. Privacy and Data Protection

8. Limitations of Liability
8.1 Disclaimer of Warranties

8.2 Exclusion of Liability

8.3 Limitation on Direct Damages
Liability for direct damages is limited to the amount paid by the User for Services in the preceding 12 months, or €100 if no payments were made.
8.4 Exceptions
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
8.5 Third-Party Disputes
The Operator is not liable for disputes between Users or between Users and listed businesses. Any transactions or interactions are at your own risk.
9. Indemnification
Users agree to indemnify, defend, and hold harmless the Operator, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms or applicable laws.
- Your Content or use of the Platform.
- Any infringement of third-party rights by you.
This indemnification survives termination of these Terms.
10. Termination
10.1 Termination by Operator
The Operator may suspend or terminate your access to the Site or Account at any time, with or without cause, including for violations of these Terms.
10.2 Termination by User
You may terminate your Account by contacting us or ceasing use of the Site.
10.3 Effects of Termination
Upon termination, all licences granted to you cease, and you must destroy any downloaded materials. The Operator may retain your data as required by law.
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms are governed by the laws of France, without regard to conflict of laws principles.
11.2 Jurisdiction
Any disputes shall be subject to the exclusive jurisdiction of the courts in Paris, France, unless EU consumer laws provide otherwise.
11.3 Alternative Dispute Resolution
We encourage informal resolution. For EU residents, the European Online Dispute Resolution platform may be used.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with incorporated documents, constitute the entire agreement between you and the Operator.
12.2 Severability
If any provision is held invalid, the remainder shall remain in effect.
12.3 Waiver
No waiver of any term shall be deemed a further or continuing waiver.
12.4 Assignment
The Operator may assign these Terms without your consent; you may not assign without our written approval.
12.5 Force Majeure
The Operator is not liable for failures due to Force Majeure Events.
